What Should I Include in my Will?

Now you know the importance of writing a Will, and of working with our expert solicitors to ensure it is clear and valid, it’s time to figure out what needs to be included. We have outlined, in the following paragraphs, some of the most standard inclusions, but this will differ from person to person depending on your circumstances. Again, our team is on hand to help you ensure you have included in your Will everything that is relevant to you and your family. Give Freelands Solicitors a call to book an appointment to discuss this in detail with one of our experts - contact details for both our Motherwell and Wishaw offices can be found at the bottom of this article, or on our “contact us” page.

An Executor

The nominated Executor of your Will is the person who will be responsible for ensuring that your wishes are upheld and your estate is dealt with in exactly the way you have set out in your Will. It is advisable to also select a reserve or substitute Executor, to ensure that in the event that your nominated Executor is unable to fulfil their role, you have approved someone else to take their place. The Executor of your Will will have certain duties to fulfil, including distributing your assets to the beneficiaries listed, closing any bank accounts and more, depending on your circumstances. To find out more about the duties associated with being an Executor, don’t hesitate to get in touch.

Your Assets

All money, property and possessions, and other assets you own at the time of your death are known as your “estate”. Your estate can be left entirely to one person, or divided up in whichever way you choose. You can leave particular assets to named people, or you can make more general provisions without listing specific items. It is worth noting that certain clauses in other documents including property title deeds or insurance policies can override what is outlined in a Will - this is another example of the importance of having one of our qualified solicitors help you with the Will writing process. Ensure that all of your assets are included and that they will ultimately end up in the hands of your chosen beneficiary by booking a meeting with Freelands Solicitors today.

Your Beneficiaries

After making a full list of your assets, it’s time to decide who you wish to leave them to. Beneficiaries can include family members or friends, but could also include charities or other organisations. You have full control over who you list here - you can choose to leave everything to one person or organisation, or divide it up in shares or on a possession by possession basis. For more information on choosing your beneficiaries, give Freelands Solicitors a call - contact details for both our Motherwell and Wishaw offices can be found at the bottom of this article, or on our “contact us” page.

Instructions for the care of any children under 16

If you have any children under the age of 16, it is important to have a plan in place, outlining who is to look after them in the event of your death. This should be included in your Will, giving you the peace of mind that they will be well taken care of by the person or people you have chosen.
