Executry

The process of winding up a person’s estate after they die is known as an Executry, or Estate Administration. Applying for Confirmation

Following a death in Scotland, the Executor must apply for a Grant of Confirmation in order to begin the process of winding up the estate. This should be applied for through the Sheriff Court, and will give the Executor the necessary authority to start the process of dealing with the assets. In order to apply for Confirmation, the total value of the Estate must be calculated and provided to the court in an Inventory. This process can be overwhelming in the early stages after the loss of a loved one, which is where our solicitors can help. Winding up the estate

Once Confirmation has been granted, the terms of the Will can be followed and the assets can be divided up accordingly. Inheritance Tax

Another aspect of the Executry Process which may require to be dealt with by the Executor following a death is Inheritance Tax (IHT). This is tax “paid when a person's estate is worth more than a specific amount (set from time to time by the Government - currently £325,000) when they die”.
