Executry

The process of winding up a person’s estate after they die is known as an Executry, or Estate Administration. This can be a difficult and stressful time for loved ones, and our aim at Freelands Solicitors is to help make this process as smooth as possible. Our experts can help you through the legal procedures which must be followed upon the death of a family member, ensuring that everything is done properly.

Applying for Confirmation

Following a death in Scotland, the Executor must apply for a Grant of Confirmation in order to begin the process of winding up the estate. This should be applied for through the Sheriff Court, and will give the Executor the necessary authority to start the process of dealing with the assets. In order to apply for Confirmation, the total value of the Estate must be calculated and provided to the court in an Inventory. This process can be overwhelming in the early stages after the loss of a loved one, which is where our solicitors can help. Contact us now for expert advice in applying for the Grant of Confirmation.

Winding up the estate

Once Confirmation has been granted, the terms of the Will can be followed and the assets can be divided up accordingly. If no Will has been left, this becomes a much more complicated process, which will require further legal advice - please don’t hesitate to get in touch with us here at Freelands Solicitors with any questions in this area.

Inheritance Tax

Another aspect of the Executry Process which may require to be dealt with by the Executor following a death is Inheritance Tax (IHT). This is tax “paid when a person's estate is worth more than a specific amount (set from time to time by the Government - currently £325,000) when they die”. There are, however, exemptions to this, and our team of highly qualified solicitors are on hand to guide you through this. If properly planned for in advance, there are ways to reduce the Inheritance Tax through these exemptions. Contact us now and book a meeting at either our Motherwell or Wishaw office to discuss your options.
